3. What is Personal Data?

Personal data is data and information that relates to an identified or identifiable natural person.

4. For which purposes do we process your personal data? On which legal basis does this take place?

Below we describe the purposes for which and the legal basis on which we process your personal data.

The processing of your data by the social media platform providers may be based on different legal grounds. Mewa has no influence on the data processing procedures of the platform providers and we do not know in detail how the social media platforms use the data from your visit to our social media pages and interaction with our posts for their own purposes, how long this data is stored and whether data is passed on to third parties. We also have no information on the deletion of the collected data by the providers of the platforms. The data processing may differ depending on whether you are registered and logged in to the social network or visit the site as a non-registered and/or non-logged-in user. When you access a post or the social media page, the IP address assigned to your end device is transmitted to the provider of the social media platform. If you are currently logged in as a user, a cookie on your end device can be used to track how you have moved around the network. Using buttons or content embedded in web pages, it is also possible for certain providers to track your visits to these web pages and, if necessary, to assign them to your profile. Based on this data, content or advertising can be tailored to suit you. If you want to avoid this, you should log out or deactivate the "stay logged in" function, delete the cookies present on your device and restart your browser.

Which data the social media platform providers receive and how they are used is described by the providers in their data protection notices. There you will also find information on contact options as well as on the setting options for advertisements. Details:

4.1 Informational use of our social media sites

You can visit our website without providing any personal information. If you only use our websites for information purposes, i.e. if you do not register or otherwise provide us with information about yourself, we do not process any personal data, with the exception of the data that the respective provider transmits to us. When you visit our websites, the providers of the social media platforms collect, among other things, your IP address as well as other information that is collected in the context of cookies on your terminal device. This information is used to provide us, as the operator of the site, with statistical information about interaction with us (see section 4.2).

4.2 Analysis and tracking

For the purpose of analysing and tracking the use of their social media platform as well as our website, the providers use cookies that enable an evaluation of your surfing behaviour. This can improve the quality of the platform and appearance and their content. We learn how our website is used and can thus constantly optimise our offer, but we do not have access to the personal data behind it. We can only influence the statistics provided by the platform providers to a limited extent and cannot switch them off.

We process your personal data on the basis of your consent pursuant to Art. 6 (1) p. 1 lit. a European General Data Protection Regulation (GDPR), which you have given to the provider upon registration or within the framework of the Cookie Consent Manager of the respective social media platform.

4.3 Active use of the performances

We, as the operator of the respective social media site, also process data from your active use of the site. In addition to the processing of your personal data outlined above, we then process further data from you that we need, for example, to process your enquiry or to interact with you on our own initiative. In this context, we also use the social media management tool "SocialHub" (see section 4.4).

You can comment, share or otherwise interact (like, recommend, review, etc.) with posts, photos, videos, etc. created by us on the provider's platform and on our website. We may share your content on our site if this is a feature of the platform and communicate with you through the platform. If this should be necessary, we reserve the right to delete content.

You can also send us enquiries via the platforms. Depending on the response required, we may also refer you to other secure communication channels that guarantee confidentiality. You always have the option of sending us confidential enquiries to our address stated in the imprint or in this data protection information.

We process your personal data on the basis of our legitimate interest in providing an interaction and information offer, the analysis and optimisation of the same and the interaction with you pursuant to Art. 6 para. 1 p. 1 lit. f GDPR or to initiate a contract with you pursuant to Art. 6 para. 1 p. 1 lit. b GDPR.

4.4 Social Media Management via "SocialHub”

For a central and efficient management of our social media presences on Facebook, Instagram and LinkedIn, we use the software "SocialHub" by maloon GmbH (Schütterlettenweg 4, 85053 Ingolstadt). We use this to manage and respond to incoming enquiries on and interactions with our social media performances. The personal data that you publish on our social media pages or that are included in personal enquiries to us, in particular user name and communication content, are transferred via interfaces of the social media platforms to a server of SocialHub and stored there for the time of processing. The personal data is regularly deleted from SocialHub within 90 days, provided that there are no legal retention obligations to the contrary or consent to further processing has been given. The service provider processes this data only in accordance with our instructions as an order processor. In a corresponding order processing contract pursuant to Art. 28 GDPR, the service provider has also undertaken to process the data only within the EU or the EEA. The legal basis for the processing of personal data with the "SocialHub" software is our legitimate interest in a central and efficient management of our social media performances (Art. 6 para. 1 p. 1 lit. f GDPR).

4.5 Meta "Engagement Custom Audiences”

We use the remarketing function "Engagement Custom Audiences" of Meta Platform Ireland Ltd, Merrion Road, Dublin 4, D04 X2K5, Ireland ("Meta").

When you visit our social media performances on the platforms provided by Meta or otherwise interact with our content on the Meta platforms, Meta stores information about this and assigns it to your respective user account. We use the aggregated information for remarketing purposes so that you can be shown interest-based advertisements when you visit the Facebook platform or other websites that also use the process, or when you use other Meta Company products. We do not gain access to the personal data behind this. We want to use Custom Audiences to ensure that our ads match your potential interests. This also serves to ensure that advertising content that has already been shown to you is not presented to you again. We do not know in detail whether and to what extent Meta also uses this data for its own purposes. For details, please refer to the provider's privacy policy.

We process your personal data on the basis of your consent pursuant to Art. 6 (1) sentence 1 lit. a GDPR, which you have given to the provider upon registration or within the framework of the Cookie Consent Manager of the respective meta platform.

4.6 LinkedIn "Matched Audiences”

We use the remarketing function "Matched Audiences" of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland ("LinkedIn").

When you visit our LinkedIn site or interact with our content on the LinkedIn platform in other ways, LinkedIn stores information about this and associates it with your respective user account. We use the aggregated information for remarketing purposes in the LinkedIn Campaign Manager so that you can be shown interest-based advertisements when visiting the LinkedIn platform and, if applicable, on pages of external partners of LinkedIn. We do not gain access to the personal data behind this. We want to use Matched Audiences to ensure that our ads match your potential interests. We do not know in detail whether and to what extent LinkedIn also uses this data for its own purposes. For details, please refer to the provider's privacy policy.

We process your personal data on the basis of your consent pursuant to Art. 6 (1) p. 1 lit. a GDPR, which you have given to the provider upon registration or within the framework of the Cookie Consent Manager of the LinkedIn platform.

4.7 LinkedIn "Sales Navigator”

We use the "Sales Navigator" service of LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland ("LinkedIn") to address, manage and expand our contacts and leads.

We use the tool to find suitable contacts for us and our products and services and to contact them directly via the integrated messaging function on LinkedIn in order to present our products and services. We only use personal data that is available on the LinkedIn platform for this purpose.

Data processing is carried out within the framework of the user agreement you have concluded with LinkedIn and on the basis of our legitimate interest in initiating and maintaining business contacts in accordance with Art. 6 (1) sentence 1 lit. f GDPR. In addition, LinkedIn also uses the data on the platform for its own purposes. For details, please refer to the provider's privacy policy.

4.8 Further data processing in individual cases

We also process your personal data in individual cases in order to fulfil legal obligations. In particular, this includes retention periods under commercial, trade or tax law. We process your personal data in accordance with Art. 6 (1) sentence 1 lit. c GDPR in conjunction with commercial, trade or tax law, insofar as we are obliged to record and store your data. In addition, it may be necessary in individual cases to process your data in order to assert our rights and enforce our legal claims or insofar as this is necessary to prevent or prosecute criminal offences. We process your personal data for these purposes to protect our legitimate interests in accordance with Art. 6 (1) p. 1 lit. f GDPR.

Who receives your data and is it sent to a third country or an international organisation?

Initially, only our employees who are involved with technical, commercial or editorial support of the social media performances will be aware of your personal data. Your data will only be passed on to third parties if this is permitted or required by law or if you have given your consent.

In addition, we use IT service providers within the scope of the data processing explained above, e.g. within the scope of SocialHub or for the support of the social media performances or individual functionalities as well as for analysis. As far as service providers receive your personal data as a data processor, they are strictly bound by our instructions when handling your personal data.

We do not transfer your personal data to countries outside the EU or the EEA or to international organisations. However, the data concerning you may be transferred by the platform providers to countries outside the European Union, in particular the USA. A level of data protection that corresponds to that of the EU cannot always be guaranteed there.
